On January 4, 2024, the Ministry of Health and Welfare of Taiwan, China, issued four cosmetics related announcements: abolishing the Benchmark Table for the Use and Limits of Antimicrobial Ingredients in Cosmetics and the Table for the Names and Limits of Cosmetic Ingredients for Specific Purposes, formulating the List of Limits on the Use of Cosmetic sunscreen Ingredients, and amending the List of Limits on the Use of Cosmetic Ingredients.

1. Benchmark Table for the Use and Limit Regulation of Antimicrobial Ingredients in Cosmetics

Reasons for abolition: After checking the European Union, the United States, Japan, ASEAN and other international countries, there is no antibacterial agent composition list for cosmetics; For relevant ingredients, the department shall formulate restrictions on their use in accordance with the authorization of Item 3, Article 6 of the Cosmetics Health and Safety Management Law, and the repeal will take effect on July 1, 2024.

2. List of Ingredients Names and Limits for Specific Purpose Cosmetics

Reasons for annulment: In accordance with the provisions of Item 7 of Article 5 of the Law on the Health and Safety Management of Cosmetics, the provisions of Item 1 and Item 2 of the same article concerning cosmetics for specific purposes, the original provisions of the List of Restrictions on the Use of Cosmetic Ingredients and the List of Restrictions on the Use of Cosmetic Sunscreen Ingredients will be incorporated into the List of Restrictions on the Use of Cosmetic Ingredients and the List of Restrictions on the Use of Cosmetic sunscreen Ingredients, and the repeal will take effect on July 1, 2024.

3. Restrictions on the Use of Cosmetic Sunscreen Ingredients

In order to ensure the safety of cosmetics for consumers, the provisions of Item 1 and Item 2 of the same article concerning cosmetics for specific purposes shall cease to apply on July 1, 2024, after referring to the international regulations on cosmetics management and in accordance with the provisions of Item 5, Item 7 of the Law on the Health and Safety of Cosmetics. A total of 27 sunscreen ingredients originally stipulated in the List of Names and Limits of Use of Cosmetic Ingredients for Specific Purposes and Titanium dioxide ingredients originally stipulated in the List of Limits of Use of Cosmetic Ingredients have been combined into the List of Limits of Use of Cosmetic Sunscreen Ingredients. Will take effect on July 1, 2024 (subject to the date of manufacture).

4. List of Restrictions on the Use of Cosmetic Ingredients

To ensure the health and safety of consumers, part of the ingredients originally stipulated in the List of Names and Limits for Use of Cosmetic Ingredients for Specific Purposes and the Benchmark List of Limits for Use and Limits of Antimicrobial Ingredients in Cosmetic Products are transferred to this table, and the product types and matters for attention in this table are revised according to the international management standards for cosmetic products. 122 items were added, 31 items were amended, and two items were deleted, and the explanation at the end of the amendment table. Will take effect on July 1, 2024 (subject to the date of manufacture).

The specific amendments are as follows:

Add 115 ingredients originally stipulated in the List of Names and Limits for Use of Cosmetic Ingredients for Specific Purposes (except sunscreens) and amend the list of 7 ingredients including Allantoin which are listed together with this list.

Add eight ingredients originally stipulated in the Benchmark Table for the Use and Limit Regulation of Antimicrobial Ingredients in Cosmetics. Triclocarban shall be amended with reference to the same ingredient in the List of Names and Limits for Use of Cosmetic Ingredients for Specific Purposes.

To amend the ingredient name of Cantharids tincture as currently stipulated.

Refer to the international cosmetics regulatory code to amend the current provisions of Ammonium Mon fluorophosphate and other 23 components of the product types.

Delete the binomial components of Titanium dioxide and Magnesium fluoride. Then the component numbers are passed forward in order.

According to the amendment or deletion of the current prescribed ingredients, delete (1), (2), (4) and (5) at the end of the table, move (3) to note, and add two items related to the description of hair dyeing, decolorization, dyeing and perm products, etc.
